Deca

Terms of Service

Last updated: October 31, 2026. These terms apply when you buy a Deca Agency plan online. Deca Agency is a Florida sole proprietorship operated by Nick Bonollo, Tampa, Florida. If you also sign a written service agreement with us, that agreement controls where it differs from this page.

1. Plans and fees

What each plan includes is described on our pricing section. Prices are in US dollars. Sales tax is added where required.

2. Billing

The setup fee and first month are charged at checkout. After that, your plan renews automatically every month on the date you signed up, using the payment method you gave at checkout. Payments are processed by Stripe; we never see or store your full card number.

3. Term and cancellation

Plans have a 3-month minimum term, then continue month to month. After the minimum term, either party may cancel with 30 days' written notice (email is fine). You may give notice during the minimum term so it takes effect when the minimum term ends.

4. Refunds

The setup fee is non-refundable once work has started. Monthly fees are billed in advance and are not prorated or refunded for partial months.

5. Advertising spend

For plans that include Google Ads, ad spend is paid by you directly to Google and is separate from our fee. We don't guarantee any specific number of leads, calls, rankings, or sales.

6. Ownership

You own your website content, domain, Google Business Profile, Google Ads account and data, and the content and logos you supply. Once all fees are paid, you own the final website content we create for you. We keep ownership of our templates, tools, and know-how.

7. AI assistant

The AI chat and voice assistants answer from information you approve. They can make mistakes; we monitor and correct them, but you're responsible for reviewing what they say about your prices, services, and policies.

8. Limitation of liability

Our total liability is limited to the fees you paid us in the 3 months before the claim. Neither party is liable for indirect or consequential damages.

9. Governing law

Florida law governs these terms.

10. Notices and contact

Send notices, including cancellation notices, by email.
